About My Homeroom
My Homeroom LLC ("My Homeroom," "we," "us," or "our") is a North Carolina Limited Liability Company operating a curated matching and referral service that connects families with independent educators for home-based tutoring, homeschool guidance, and enrichment services in the Charlotte, NC area.
These Terms of Use govern your access to and use of our website at myhomeroom.org and any services we provide to you.
Nature of Our Service
My Homeroom is a matching and referral platform — not a tutoring agency, school, or direct education provider. We facilitate connections between families and independent contractors (educators) but are not a party to the service relationship between them once a match is made.
Educators matched through My Homeroom are independent contractors, not employees of My Homeroom LLC. My Homeroom does not supervise, direct, or control the manner in which educators provide their services.
My Homeroom is not responsible for the quality, safety, legality, or outcome of educational services provided by matched educators. Families engage educators at their own discretion following our introduction.
For Families — Your Responsibilities
By submitting a family intake form or using our matching service, you agree to:
- Provide accurate and truthful information about your child and your needs
- Communicate respectfully with My Homeroom and with matched educators
- Honor agreed-upon session schedules and provide reasonable notice for cancellations
- Pay for sessions as agreed with the matched educator, processed through the My Homeroom platform
- Not contact or engage educators introduced through My Homeroom directly outside the platform for the purpose of bypassing the service relationship
- Provide a safe, appropriate home environment for sessions
Family Non-Circumvention
By creating an account and accessing educator profiles through My Homeroom, you agree not to directly hire, engage, or solicit any educator introduced through the platform outside of the My Homeroom platform for a period of twelve (12) months from your last active session or platform activity.
This obligation exists because My Homeroom invests significant time and resources in recruiting, vetting, interviewing, and credentialing every educator in our network. Circumventing the platform deprives My Homeroom of the compensation that makes this vetting process possible.
If you wish to continue working with a matched educator outside the platform for any reason, please contact us at hello@myhomeroom.org to discuss a transition arrangement.
For Educators — Your Responsibilities
By submitting an educator application or participating in the My Homeroom network, you agree to:
- Provide accurate and complete information during the application and vetting process
- Maintain professional conduct in all interactions with families and children
- Honor the Independent Contractor Agreement signed with My Homeroom LLC
- Comply with all applicable laws regarding working with children in North Carolina
- Report any concerns about a child's welfare to appropriate authorities as required by law
- Not solicit families introduced through My Homeroom for direct engagement outside the platform during the term of your agreement and for twelve months following its conclusion
Educator Non-Solicitation & Non-Circumvention
During the term of your agreement with My Homeroom and for a period of twelve (12) months following its termination for any reason, you agree to the following:
- Non-Solicitation: You will not directly solicit, contact, or accept engagement from any family introduced through My Homeroom LLC for the purpose of providing services similar to those provided through the platform, without the express written consent of My Homeroom LLC.
- Non-Circumvention: You will not circumvent, avoid, bypass, or otherwise undermine My Homeroom LLC's interest in any transaction with families introduced through the platform. This includes accepting direct payment from a My Homeroom family for services that would otherwise be booked through the platform.
- Confidentiality of Family Information: You will not use family contact information — including names, addresses, phone numbers, or email addresses — obtained through My Homeroom for any purpose other than fulfilling matched sessions through the platform.
These restrictions are narrowly tailored to protect My Homeroom's legitimate business interests and apply only to families you were introduced to through the My Homeroom platform — not to families you independently developed relationships with outside of the platform.
North Carolina courts have upheld non-solicitation and non-circumvention clauses of this nature when they are reasonable in scope and duration. By participating in the My Homeroom network, you acknowledge that these restrictions are reasonable and necessary.
Payments & Fees
My Homeroom charges a 20% platform fee on all sessions booked through our service. This fee is deducted before educator payouts. Families pay the full session rate; educators receive 80% of that rate.
All payments are processed through secure third-party platforms. My Homeroom does not store payment card information. By using our payment processing service, you also agree to the terms of our payment processor.
Session rates are agreed upon between the family and the educator prior to the first session. My Homeroom will communicate the agreed rate clearly before any payment is collected.
No Guarantees
My Homeroom makes every effort to match families with qualified, suitable educators. However, we cannot guarantee specific outcomes, academic results, or that any particular match will be a perfect fit. If a match is not working, we will work with the family to find a better one at no additional cost.
My Homeroom does not guarantee the continuous availability of any specific educator. Educators may become unavailable due to personal circumstances, scheduling changes, or removal from our network.
Limitation of Liability
To the fullest extent permitted by applicable law, My Homeroom LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our service or from any educational services provided by matched educators.
My Homeroom's total liability to any user shall not exceed the amount paid to My Homeroom for the specific service giving rise to the claim in the three months preceding the claim.
Intellectual Property
All content on the My Homeroom website — including text, design, branding, and imagery — is owned by My Homeroom LLC and may not be copied, reproduced, or used without our written permission.
The My Homeroom name, logo, and brand identity are proprietary. Unauthorized use of our brand is prohibited.
Acceptable Use
You agree not to use the My Homeroom website or service to:
- Submit false, misleading, or fraudulent information
- Harass, intimidate, or harm any educator, family, or My Homeroom staff
- Circumvent our platform to avoid payment of the My Homeroom service fee
- Use our service for any unlawful purpose
- Attempt to gain unauthorized access to our systems or data
Termination
My Homeroom reserves the right to suspend or terminate access to our service for any user who violates these Terms of Use, engages in fraudulent or harmful behavior, or whose participation is otherwise deemed inconsistent with the values and safety standards of our community.
Governing Law
These Terms of Use are governed by the laws of the State of North Carolina. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Mecklenburg County, North Carolina.
Refund Policy
My Homeroom is committed to ensuring families feel confident in their investment. Our refund policy is as follows:
Membership Plans
Monthly membership fees are billed at the start of each billing cycle. If you are unsatisfied with your match within the first thirty (30) days of your initial plan purchase, contact us at hello@myhomeroom.org and we will provide a full refund of your first month's membership fee or find you a new match at no additional charge — your choice.
After the first thirty (30) days membership fees are non-refundable for the current billing cycle. You may cancel at any time and your membership will remain active through the end of the current billing period with no further charges.
Browse Access Fee
The $10 browse access fee is non-refundable once your account has been activated and educator profiles have been made visible to you.
Session Cancellations
Individual session cancellations are subject to the following policy:
- Cancellations made more than 24 hours before a scheduled session — full session credit applied to your next session
- Cancellations made less than 24 hours before a scheduled session — session fee is forfeited unless the cancellation was due to illness or emergency
- Cancellations initiated by the educator — full session credit applied automatically with no penalty to the family
Rematch Guarantee
If your matched educator is not the right fit for any reason My Homeroom will find you a new match at no additional cost. There is no limit on rematches. Your membership continues uninterrupted during the rematch process.
How to Request a Refund
To request a refund contact us at hello@myhomeroom.org with your account email and a brief description of your concern. We aim to respond to all refund requests within two business days.
Changes to These Terms
We may update these Terms of Use from time to time. Changes will be posted on this page with an updated effective date. Continued use of our service following any updates constitutes your acceptance of the revised terms.
Educator Independent Contractor Agreement
This Independent Contractor Agreement ("Agreement") is entered into between My Homeroom LLC, a North Carolina Limited Liability Company ("My Homeroom," "Company"), and the individual educator ("Contractor") who submits an application and is accepted into the My Homeroom educator network. By checking the agreement box during the educator signup process, Contractor acknowledges having read, understood, and agreed to be bound by the terms of this Agreement.
1. Independent Contractor Status
Contractor is an independent contractor and not an employee, partner, agent, or joint venturer of My Homeroom LLC. Nothing in this Agreement shall be construed to create an employer-employee relationship between the parties.
- Contractor is solely responsible for all federal, state, and local taxes on compensation received under this Agreement, including self-employment taxes
- My Homeroom will not withhold income taxes, Social Security, Medicare, or any other payroll taxes from Contractor payments
- My Homeroom will issue a Form 1099-NEC to Contractor for any calendar year in which total payments equal or exceed $600
- Contractor is responsible for maintaining any required licenses, certifications, or permits necessary to provide educational services in North Carolina
- Contractor retains the right to provide services to other clients, platforms, and families outside of those introduced through My Homeroom, subject to the non-solicitation and non-circumvention provisions of this Agreement
2. Services
Contractor agrees to provide in-home educational services to families matched through the My Homeroom platform, which may include one or more of the following service categories:
- Academic Support — one-on-one tutoring in core subjects including reading, writing, mathematics, science, and study skills for learners in grades K through 12
- Homeschool Guidance — curriculum support, co-teaching, routine building, and homeschool structure assistance for families educating children at home
- Enrichment — private instruction in art, music, creative writing, foreign languages, drama, and other enrichment subjects
Contractor determines the manner, method, and means of delivering educational services, consistent with the needs of the matched family and the standards of My Homeroom. My Homeroom does not supervise or direct Contractor's teaching methods.
All sessions shall take place in the matched family's home or another mutually agreed upon location. Contractor agrees to conduct sessions in a professional, safe, and appropriate manner at all times.
3. Compensation
Contractor shall receive a percentage of all session fees collected by My Homeroom from matched families for sessions provided by Contractor. The specific compensation rate is communicated to Contractor during the onboarding process and confirmed prior to the first matched session.
Payments shall be made to Contractor via Zelle or such other payment method as mutually agreed, on a monthly basis following receipt of family payment. My Homeroom shall make reasonable efforts to process educator payouts within seven (7) business days of receiving family payment.
My Homeroom reserves the right to adjust the compensation structure with thirty (30) days written notice to active Contractors.
4. Background Check
A criminal background check through My Homeroom's designated third-party screening provider is required before any educator profile is made visible to families. There is no upfront cost to apply or create a profile.
My Homeroom reserves the right to deny or revoke platform access based on the results of any background check.
5. Vetting & Background Check Requirements
Prior to activation of any educator profile, Contractor must successfully complete the following vetting process:
- Submission of a complete educator application including credentials, degree information, subjects taught, grade levels, and availability
- A personal interview with the My Homeroom founder or designated representative
- Verification of stated credentials and degree fields
- Completion of a third-party criminal background check through My Homeroom's designated screening provider
- Submission of at least one professional or personal reference, which My Homeroom may contact
- Completion of a Form W-9 for tax reporting purposes
My Homeroom reserves the right to deny or revoke platform access based on the results of any background check, reference check, or any information that comes to My Homeroom's attention regarding Contractor's suitability to work with children.
6. Professional Standards & Conduct
Contractor agrees to maintain the following professional standards throughout the term of this Agreement:
- Arrive on time and prepared for every scheduled session
- Provide reasonable advance notice — no less than 24 hours — for any session cancellation or rescheduling
- Communicate professionally and respectfully with families at all times
- Never be alone with a child in a manner that violates reasonable child safety standards
- Report any suspected child abuse or neglect to appropriate NC authorities as required by NC General Statute 7B-301
- Never engage in any romantic, sexual, or otherwise inappropriate relationship or communication with any family member, student, or minor
- Maintain appropriate professional boundaries in all interactions with matched families
- Not discuss compensation, platform fees, or business arrangements with matched families
Violation of any professional standard listed above may result in immediate removal from the My Homeroom network without notice.
7. Non-Solicitation
During the term of this Agreement and for a period of twelve (12) months following its termination for any reason, Contractor agrees not to directly solicit, contact, or accept engagement from any family introduced through My Homeroom LLC for the purpose of providing services similar to those provided through the platform, without the express written consent of My Homeroom LLC.
This restriction applies specifically to families introduced through the My Homeroom platform and does not restrict Contractor from working with families developed independently through Contractor's own marketing, referrals, or prior relationships that predate the My Homeroom introduction.
8. Non-Circumvention
Contractor agrees not to circumvent, avoid, bypass, or otherwise undermine My Homeroom LLC's interest in any transaction with families introduced through the platform. This prohibition includes but is not limited to:
- Accepting direct cash, check, Venmo, Zelle, or any other form of payment from a My Homeroom family for services that would otherwise be booked through the platform
- Providing services to a My Homeroom family under a different business name or through a different platform to avoid the My Homeroom commission
- Encouraging or facilitating a family's decision to leave the My Homeroom platform in order to work directly with Contractor
- Sharing personal contact information with matched families for the purpose of arranging off-platform sessions
9. Confidentiality
Contractor agrees to keep confidential all information about matched families including but not limited to names, addresses, phone numbers, email addresses, children's names and ages, learning needs, and any personal information shared during the course of providing services.
Contractor shall not use family information for any purpose other than providing matched educational services through the My Homeroom platform. This confidentiality obligation survives the termination of this Agreement.
Contractor also agrees to keep confidential any information about My Homeroom's business operations, pricing, educator compensation, matching processes, technical infrastructure, automation systems, software integrations, platform architecture, or other proprietary business information.
10. Insurance & Liability
Contractor acknowledges that My Homeroom does not provide general liability insurance, professional liability insurance, workers' compensation, or any other insurance coverage for Contractor's activities. Contractor is solely responsible for obtaining and maintaining any insurance coverage deemed appropriate for providing in-home educational services.
Contractor agrees to indemnify, defend, and hold harmless My Homeroom LLC, its members, managers, employees, and agents from and against any claims, damages, losses, or expenses — including reasonable attorney's fees — arising from Contractor's provision of services to matched families.
11. Term & Termination
This Agreement begins on the date Contractor's profile is activated on the My Homeroom platform and continues until terminated by either party.
- Termination by Contractor: Contractor may terminate this Agreement at any time by providing written notice to hello@myhomeroom.org. Contractor remains obligated to fulfill any sessions already scheduled with matched families for a period of no less than fourteen (14) days following notice, unless My Homeroom waives this requirement.
- Termination by My Homeroom: My Homeroom may terminate this Agreement at any time with or without cause. In the event of termination for cause — including but not limited to violation of professional standards, breach of non-solicitation or non-circumvention obligations, or failed background check — termination is effective immediately without notice.
- Effect of Termination: Upon termination, Contractor's profile will be deactivated and Contractor will no longer receive new family matches. Compensation for sessions completed prior to the termination date will be paid in accordance with the normal payout schedule.
The non-solicitation, non-circumvention, and confidentiality provisions of this Agreement survive termination and remain in full force for the periods specified.
12. ESA+ & ClassWallet
My Homeroom is a registered ESA+ provider in North Carolina. For families paying through the NC Education Savings Account Plus (ESA+) program via ClassWallet, payment flows directly to My Homeroom LLC through the ClassWallet system. Contractor payouts for ESA+ sessions follow the same 80/20 split and are processed by My Homeroom on the same schedule as standard session payments.
Contractor agrees not to accept ClassWallet payments directly from ESA+ families. All ESA+ payments must flow through My Homeroom LLC as the registered provider.
13. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of North Carolina. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Mecklenburg County, North Carolina.
In the event of a dispute, the parties agree to first attempt to resolve the matter through good faith negotiation. If negotiation fails, either party may pursue any available legal remedy.
In any legal action to enforce this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs from the non-prevailing party.
14. Entire Agreement
This Agreement, together with the My Homeroom Terms of Use and Privacy Policy, constitutes the entire agreement between My Homeroom LLC and Contractor with respect to the subject matter herein and supersedes all prior discussions, representations, or agreements.
My Homeroom reserves the right to update this Agreement with thirty (30) days written notice to active Contractors. Continued participation in the My Homeroom network following notice of any update constitutes acceptance of the revised terms.
If any provision of this Agreement is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
